Any changes on employeer position, arrangement, duties or workplace will not pose for employeer employment termination, nor the right to enjoy the benefits of any termination of the labor contract. 2. 1B生效日 EFFECTIVE DATE 本雇佣合同以及其项下您的义务将于您在您的新职位的第一个工作日起始,该等日期应为Ä[插入日期]。 The employment contract and employeer obligations in employeer new position shall start in the first working day , the date should be inserted to [date] Ä[仅为现有雇员插入:就休假之权利以及其他雇用福利之目的,用人单位将承认您对用人单位的服务的连续性。] "Just insert for existing employees :for the purpose of the rights of leave and other employment benefits to the employee, employeer continuity on the employee's service shall be recognized . 3. 2B雇用的先决条件 Prerequisite of Employment 体检 Physical examination 用人单位的录用应以您向用人单位提供相关材料证明您已经与一家经注册的医疗机构完成了能让用人单位满意的体检为条件。 Employee shall be employed on the condition of relevant qualified materials that employee have completed physical examination in a registered medical institutions to be provided to employee. 雇佣文件 Employment Documents 用人单位的录用应以下列条件为前提: The employee recruitment should be subject to the following conditions: (a) 您必须提供一份您身份证或护照的复印件;以及 (b) 根据用人单位的要求,您必须提供有关您的技能与资格的所有文件的复印件。 (a) Employeer ID card or copy of employeer passport shall be provided; and (b) Employee must provide a copy of all files on employeer skills and qualifications in accordance with the requirements of the employee. 您必须将该等文件的复印件连同您的承诺一起转交给用人单位,并于您在该职位上的工作的第一天携带该等文件的原件以便确认。 Employee must have the file copy and commitment to the employee and carry the original documents to confirm in the first working day. 如果该等文件没有在您的工作开始之前被提供,您可能被要求延迟开始工作直至出示该等文件。如果您无法在用人单位合理要求的时间框架内提供该等文件,本雇用合同之要约将失效,而用人单位将不承担任何对您的费用支付或补偿之责任。 If the file is not available before employee start work, employee may be asked to delay to work until the show such documents. Employee should be on employeer first day of work to provide a no criminal proof. 4. 报酬 PAYMENT 您的起始工资为年薪人民币Ä[0.00] 元,按月发生并每月支付人民币Ä[0.00] 元至您指定的银行账户。 Employeer starting salary is RMB [0.00] yuan yearly salary, and the monthly payment of RMB [0.00] yuan to employeer designated bank account. 您的报酬将接受年度审查但并不必然发生变更。 Employeer reward will accept the annual review but not necessarily change. 5. 税 TAX 您必须支付适用于您的任何所得税。用人单位将从您的报酬中代扣您应当支付的所得税与其他任何必须的费用,并根据所适用的法律与法规将该等费用支付给相关政府机关。 Employee have to pay all income tax that employee need to pay. Tax and .any other “necessary”response costs incurred therefrom will be withhold from employeer salary and, in accordance with applicable laws and regulations, handed in to relevant government by employeer employee. 6. 3B法定社会保险与公积金(住房基金) Social Insurance and Accumulation Fund 用人单位代您缴纳您的法定住房基金与社会保险,包括养老金、医疗保险、工伤保险以及失业保险。 您必须支付根据相关法律与法规应由您个人承担的社会保险。用人单位可以从您每月工资里代扣该等费用并根据相关适用的法律与法规代您将该等费用支付给相关社会保障机关。 The accumulation fund and social insurance, including pension, medical insurance, work-related injury insurance and unemployment insurance, will be payed by employeer employee. However, such social securities that shall be born by employeerself in accordance with laws and regulations can be deducted from employeer salaries and payed to Social Security Administration by employeer employee. 7. 4B试用期Ä[仅针对新雇员] 为了确保您与用人单位都做出了正确的雇佣决定,自您与用人单位的雇佣开始之日起将有一段为期三个月的试用期。用人单位可以自行决定将试用期再延长三个月。 在试用期内,您可以选择提前3日书面通知用人单位以终止对您的雇佣。 Probation There is a three-month probation from the commencement date of the employment which helps to ensure that employee and employeer employee have made right decision of employeer employment. Employee, at his sole discretion, can extend probationary period to three (3) months/ decide a three-month extension. Employee shall file a written notice to employeer employee three(3) days in advance to terminate employment relationship during probationary period. 8. 5B工作时间 WORKING TIME 您的标准工作时间为周一至周五的早上8点半至下午5点半,中间有1小时的午餐休息时间。因确保服务的连续性与安全之需要,用人单位有权指派您在午餐休息时间进行工作。您必须遵守该等指派。 Standard working time is at half past eight in the morning to half past five in the afternoon from Monday to Friday morning, one-hour lunch break. For ensuring consistency of work and safety needs, employee is entitled to designate employee to work during lunch break and employee have to abide by such designation. Ä[仅针对无交通补助的员工:除您的工资外,您有权在下列情况下要求报销具体列出的详细金额范围内的费用: U事件 津贴 金额 The following situations only apply for employees who has no traffic subsidies: Employee are entitled to submit an expense account/apply for reimbursement of fees with detailed amount of money under such circumstances: Event: _______ allowance:______ amount of money:______ 被要求晚上8点后工作 晚餐补助 Ä人民币30元 周末及公共假日工作 午餐补助 Ä人民币10元 Work after 8o'clock in the evening Subsidies for dinner: RMB thirty(30) Work at weekends and official holidays Subsidies for lunch RMB ten(10) 晚上8点后工作之出租车从工作地点回家费用 出租车补贴 Ä实际发生的费用 Taxi fees incurred for working after 8 o’clock in the evening Subsidies for taxi actual fees 您必须于任何报销得到实际支付之前提供发票。] Employee shall provide invoice(s) before employee obtain any reimbursement/all expenses are reimbursed (to employee). Such situations apply to necessary repairing of computer system malfunctions which happens during providing financial service and correct financial records which aims to protect employee and any client of agent bank. (第二部分) 9.年假 Ä[选择适当的选项] Ä[针对第5组第2级以及该级以下的级别: For the 2nd level of the 5th group and under: 除法定节假日外,在对用人单位进行有偿服务的每个完整日历年度里,您将有15个带薪工作日的年假,或在部分日历年中按比例计算相应的年假。] In addition to national official holidays, in every whole calendar year of paid services to the employee, employee shall enjoy a paid leave of fifteen(15) days, or calculate days of annual leave proportionately in the part of calendar year. Ä[针对第5组第3级以及该级以上的级别: For the 3rd of the 5th group and above: 除法定节假日外,在对用人单位进行有偿服务的每个完整日历年度里,您将有20个带薪工作日的年假,或在部分日历年中按比例计算相应的年假。] In addition to national official holidays, in every whole calendar year of paid services to the employee, employee shall enjoy a paid annual leave of twenty(20) days, or calculate days of annual leave proportionately in the part of calendar year. 根据适用的用人单位政策与程序,年假自然产生,并且必须被使用。年假不能从一个日历年度累计到下一日历年度。如果在一个日历年度结束时您还没有使用完您所有的年假,用人单位可以要求您使用所有未使用完的年假。您必须每年最少一次使用一段不少于5个<第5组第3级以及该级以上的级别为10个>连续工作日的休息假期。 In accordance with applicable policies and procedures of the employee, annual leaves emerge naturally and shall be enjoyed. Annual leaves shall not be accumulated from one calendar year to the next. Where employee have not take all employeer annual leaves at the end of one calendar year, the employee may ask employee to use up remaining annual leaves. Employee shall at least enjoy a vocation which is no less than 5 successive working days. 雇用终止时的年假支付将按照终止之日您的工资来计算。 The compensation for days of annual leave at the termination shall be paid subject to employeer wages at the date of termination. 其他 Miscellaneous 您将获得根据适用的法律与法规您有权获得的所有其他假期。 Employee are entitled to obtain all other holidays in accordance with applicable laws and regulations. 病假 Sick leave 您有权在每个日历年内获得最多12天的病假(在每次病假时以医生的证明为前提)。该权利的累计最多不超过60天。 个别病例总病假可能超过病假权利的,将适用当地法定要求和/或个案安排。 Employee are entitled to obtain the sick leave of twelve(12) days at most(subject to a doctor’s certificate at every sick leave)in a calendar year, but accumulative sick leaves shall not be exceeded sixty(60) days. 医疗 MEDICAL 您会被提供用人单位健康关注计划下的门诊与住院计划。用人单位保留在商谈本劳动合同的年度续约时修改本权益/保护之范围的权利。 The employee shall provide employee with plans of outpatient and hospitalization subject to the health concern program. The employee reserves rights to modify such rights and interests ,or protection scope ,when negotiating the annual renewal of this labour contract. Ä[针对第4组雇员] 您和您的孩子(们)会被提供用人单位健康关注计划下的门诊与住院计划。用人单位保留在商谈本劳动合同的年度续约时修改本权益/保护之范围的权利。同时,用人单位将支付您的孩子(们)的医疗保险金。 [For employees of group 4] The employee shall provide employee and employeer children with plans of outpatient and hospitalization subject to the health concern program. The employee shall reserve rights that modify such rights and interests ,or protection scope, when negotiating the annual renew of this labour contract. At the same time, the employee shall pay employeer children’s medical insurance. Ä[针对第3组员工] 您和您的直系亲属,例如妻子和孩子(们),会被提供用人单位健康关注计划下的门诊与住院计划。用人单位保留在商谈本劳动合同的年度续约时修改本权益/保护之范围的权利。 [For employees of group 3] The employee shall provide employee and employeer direct relatives such as employeer wife and children with plans of outpatient and hospitalization subject to the health concern program. The employee shall reserve rights that modify such rights and interests ,or protection scope, when negotiating the annual renew of this labour contract. 知识产权与商业机密的所有权 Ownerships of intellectual property rights and trade secrets 本条款中“材料”指的是在您与用人单位的雇佣存续期间内所有由您创造、制作或发现(不论单独完成或与他人合作)的作品、主意、概念、设计、发明、研发、改进、电脑软件、方法、系统或其他材料或信息。 “ Material” herein means that works, ideas, conceptions, designs, inventions, developments, improvements, computer softwares, methods, systems, other materials or information which are created, made or discovered by employee(either alone or with others). 通过签订本劳动合同,您: · 同意用人单位将拥有在该等材料中的以及针对该等材料的所有权利; By signing this labour contract, employee shall agree the employee enjoy all rights in such materials and all rights against such materials. · 把材料中的所有现在与将来的权利转让给用人单位,包括所有的所有权以及与商标、专利、著作权有关的权利以及与开发、制作、使用、销售许可有关的排他性的权利或从材料中获取的其他的利益;并且 transfer all current and future rights in materials to the employee, including all ownerships , rights related to trademarks, patents ,copyrights and exclusive rights related to development, manufacture, use, seller’s permit or other interests obtaining from materials; and · 同意签署因使您在本条款下的义务完整生效而必须的或适当的任何其他文件。 agree to sign all other necessary or appropriate documents which made employeer obligations in force fully under the article herein. (第三部分) 9. 8B价值与道德标准 VALUES AND MORAL STANDARDS 行为 Conduct 用人单位已经发展出了成熟的引导价值与道德的标准,您被要求遵守该等标准。您必须确保该等标准是您与向您报告的人员在用人单位内履行职责的方式的不可分割的部分。 Employee shall comply with complicated guiding value and moral standards made by Employer, and, together with those giving report, make sure such standards become an indispensable and integral part of methods of duty performance in accordance with terms and conditions both parties agree upon. 您必须在任何时候都以一种符合您在用人单位的职位的方式诚实的开展工作。此外,您必须善意勤勉地完整地履行您的职责、行使您的权力,和进行管理并考虑到涉及用人单位雇员与客户的所有事项。
